These Terms and Conditions (“Terms”) govern all sales, services, and transactions conducted by Fusion Fab Worx LLC dba FFW Motorsports, a motorsports store and service provider (“we,” “us,” or “our”). By purchasing products or using our services, you (“Customer,” “you”) agree to these Terms.

1. Scope of Services

• We provide sales and servicing of motorsports vehicles and related products, including but not limited to motorcycles, ATVs, UTVs, dirt bikes, parts, accessories, repairs, maintenance, diagnostics, and customization services.

• All services are subject to availability and may change without prior notice.

2. Estimates & Authorization

• Repair estimates are provided based on initial inspection and are not guaranteed final prices.

• Additional repairs discovered during service will be communicated for approval before proceeding, when reasonably possible.

• Authorization to perform work may be given verbally, in writing, or electronically and constitutes acceptance of associated costs.

3. Payment Terms

• Payment is due in full upon completion of service or at the time of purchase, unless otherwise agreed in writing.

• We accept cash / credit cards / debit cards.

• Vehicles or equipment may be withheld until full payment is received.

• Late payments may be subject to storage fees and/or collection costs as permitted by law.

4. Deposits & Special Orders

• Deposits may be required for special orders, custom work, or high-value repairs.

• Special order parts are non-refundable once ordered, unless otherwise stated.

• Deposits are non-refundable if the customer cancels after work or ordering has begun.

5. Returns & Refunds

• Parts & Accessories: Returns are accepted within [10] days if unused, uninstalled, and in original packaging, subject to a restocking fee.

• Electrical parts, special orders, and clearance items are non-returnable.

• Labor and service charges are non-refundable.

• Proof of purchase is required for all returns.

6. Warranty Disclaimer

• Manufacturer warranties apply where applicable and are subject to the manufacturer’s terms.

• We do not guarantee or warranty customer-supplied parts.

• No warranty is provided for failures caused by misuse, racing, improper maintenance, or unauthorized modifications.

• To the fullest extent permitted by law, all implied warranties are disclaimed.

7. Customer-Supplied Parts

• We are not responsible for the quality, compatibility, or performance of parts supplied by the customer. Labor charges apply regardless of part failure or fitment issues.

8. Vehicle Storage & Abandonment

• Vehicles must be collected within 24 hours of service completion.

• Storage fees may apply after this period.

• Vehicles left beyond 24 hours without payment or communication may be deemed abandoned and handled in accordance with applicable laws.

9. Risk & Limitation of Liability

• Motorsports activities involve inherent risks. To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages.

  • Our liability is limited to the amount paid for the specific service or product.

  • We are not responsible for loss or damage due to theft, fire, weather, or events beyond our control.

10. Safety & Use Disclaimer

• Customer acknowledges that motorsports vehicles and parts are intended for experienced use and may be dangerous if improperly used. Customer assumes all risks associated with use, operation, and transport of products and serviced vehicles.

11. Intellectual Property

• All branding, logos, text, and materials provided by us remain our intellectual property and may not be used without written permission.

12. Governing Law

• These Terms are governed by the laws of the state in Fusion Fab Worx LLX dba FFW Motorsports is located in, without regard to conflict of law principles.

13. Changes to Terms

• We reserve the right to update or modify these Terms at any time. The most current version will be available at our premises or website.

14. Privacy Policy

• We do not share or sell mobile phone numbers or SMS opt-in/consent data with third parties or affiliates for marketing or promotional purposes.

• Mobile phone numbers and opt-in data will only be used for operational messaging and shared only with subcontractors or vendors performing support services on our behalf.

• Text messaging originator opt-in data and consent will not be shared with any third parties

15. Products & Ordering

• We make every effort to keep our website up-to-date and accurate, product availability and pricing; but we cannot guarantee that all products listed will be available at all times. We reserve the right to change the prices of our products without notice.

• We process and ship orders during normal business hours, Monday through Friday. Orders placed on weekends or holidays will be processed on the next business day. Shipping times may vary depending on your location and the shipping method selected.
